Hartzell & Whiteman has provided advice and representation
to many individuals and businesses concerning intellectual property
disputes, including those arising from trademarks, copyrights and
trade secrets. Generally speaking, trademark and copyright disputes
are the domain of federal courts while the misappropriation of trade
secrets is a state court matter. We have years of experience in
representing clients in both state and federal courts and are at
ease in either forum.
One emerging area of intellectual property law involves disputes
arising from activities on the Internet. In many cases, we have
represented the owners of domain names against claims brought by
trademark owners. Some of these disputes were resolved under the
Internet’s rules of arbitration; others were brought in federal
court under U.S. trademark law.
